Algemene voorwaarden

Deze voorwaarden zijn van toepassing op alle diensten geleverd door CAW consulting (hierna "Dienstverlener") aan de klant.
1. Offertes & overeenkomst
Offertes zijn 30 dagen geldig, tenzij anders vermeld. Een overeenkomst komt tot stand bij schriftelijk akkoord (mail volstaat) van de klant op een offerte.
2. Prijzen & facturatie
Alle prijzen zijn in euro, exclusief btw tenzij anders vermeld. Voor websites wordt het jaartarief vooraf gefactureerd. Voor projecten op maat geldt: 50% bij start, 50% bij oplevering. Facturen zijn betaalbaar binnen 14 dagen.
3. Oplevering & feedback
Oplevertermijnen zijn richttijden, behoudens uitdrukkelijk overeengekomen vaste deadline. De klant levert tijdig content, feedback en goedkeuringen aan. Vertraging in feedback verlengt de oplevertermijn.
4. Wijzigingen (scope)
Wijzigingen buiten de overeengekomen scope worden afzonderlijk geoffreerd. Kleine aanpassingen zijn inbegrepen volgens het gekozen pakket.
5. Eigendom & licenties
Na volledige betaling verkrijgt de klant een gebruikslicentie op de opgeleverde website, designs en broncode voor eigen bedrijfsdoeleinden. Componenten van derden (lettertypes, plugins, bibliotheken) blijven onderworpen aan hun eigen licentie.
6. Hosting & onderhoud
Bij websitepakketten met jaartarief omvat dit: hosting in Europa, SSL-certificaat, beveiligingsupdates en kleine inhoudelijke wijzigingen (richttijd: 1u/maand). Bij opzegging vervalt de hosting; de klant kan zijn website-bestanden op verzoek krijgen.
7. Aansprakelijkheid
De Dienstverlener kan niet aansprakelijk gesteld worden voor indirecte schade. De totale aansprakelijkheid is beperkt tot het bedrag van de betreffende opdracht. Downtime bij externe dienstverleners (host, domeinregistrar, betalingsdiensten) valt buiten de verantwoordelijkheid.
8. Opzegging
Jaarpakketten worden stilzwijgend verlengd. Opzegging kan tot 30 dagen vóór hernieuwing per e-mail.
9. Toepasselijk recht
Op deze voorwaarden is Belgisch recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechtbanken van het arrondissement van de Dienstverlener.

Ces conditions s'appliquent à tous les services fournis par CAW consulting (ci-après "le Prestataire") au client.
1. Devis & contrat
Les devis sont valables 30 jours, sauf indication contraire. Un contrat est conclu par accord écrit (e-mail suffit) du client sur un devis.
2. Prix & facturation
Tous les prix sont en euros, hors TVA sauf indication contraire. Pour les sites web, le tarif annuel est facturé à l'avance. Pour les projets sur mesure : 50 % au démarrage, 50 % à la livraison. Les factures sont payables sous 14 jours.
3. Livraison & feedback
Les délais sont indicatifs sauf délai ferme convenu explicitement. Le client fournit le contenu, le feedback et les approbations en temps voulu. Un retard de feedback prolonge le délai de livraison.
4. Modifications (périmètre)
Les modifications hors périmètre convenu font l'objet d'un devis séparé. Les petites adaptations sont incluses selon le pack choisi.
5. Propriété & licences
Après paiement intégral, le client obtient une licence d'utilisation sur le site, les designs et le code livrés à des fins professionnelles. Les composants tiers (polices, plugins, bibliothèques) restent soumis à leur propre licence.
6. Hébergement & maintenance
Les packs avec tarif annuel incluent : hébergement en Europe, certificat SSL, mises à jour de sécurité et petites modifications de contenu (indicatif : 1h/mois). En cas de résiliation, l'hébergement prend fin ; le client peut obtenir ses fichiers sur demande.
7. Responsabilité
Le Prestataire ne peut être tenu responsable des dommages indirects. La responsabilité totale est limitée au montant de la mission concernée. Les indisponibilités de prestataires externes (hébergeur, registrar, paiements) sont hors responsabilité.
8. Résiliation
Les packs annuels sont reconduits tacitement. La résiliation peut se faire par e-mail jusqu'à 30 jours avant le renouvellement.
9. Droit applicable
Ces conditions sont régies par le droit belge. Les litiges relèvent des tribunaux compétents de l'arrondissement du Prestataire.

Terms & conditions

These terms apply to all services delivered by CAW consulting ("the Provider") to the client.
1. Quotes & agreement
Quotes are valid for 30 days unless stated otherwise. An agreement is formed when the client confirms a quote in writing (email is sufficient).
2. Pricing & invoicing
All prices are in euros, excluding VAT unless stated otherwise. For websites, the yearly fee is invoiced upfront. For custom projects: 50% at start, 50% on delivery. Invoices are payable within 14 days.
3. Delivery & feedback
Delivery times are indicative unless a fixed deadline has been explicitly agreed. The client provides content, feedback and approvals in a timely manner. Feedback delays extend the delivery time.
4. Changes (scope)
Changes outside the agreed scope are quoted separately. Small adjustments are included according to the chosen package.
5. Ownership & licenses
After full payment, the client receives a usage license for the delivered website, designs and source code for their own business purposes. Third-party components (fonts, plugins, libraries) remain subject to their own licenses.
6. Hosting & maintenance
Website packages with a yearly fee include: European hosting, SSL certificate, security updates and small content edits (guideline: 1h/month). On cancellation, hosting ends; the client can request their website files.
7. Liability
The Provider cannot be held liable for indirect damages. Total liability is capped at the amount of the relevant engagement. Downtime of third-party providers (host, registrar, payment processors) is out of scope.
8. Termination
Yearly packages renew automatically. Cancellation is possible by email up to 30 days before renewal.
9. Governing law
These terms are governed by Belgian law. Disputes fall under the competent courts of the Provider's district.
